This document is an electronic record in terms of Information Technology Act, 2000 and rules made there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Service for access or usage of the Service.

PLEASE READ THESE TERMS OF SERVICE (“AGREEMENT”) CAREFULLY BEFORE USING THE SERVICES OFFERED BY SHAILENDRA JAIN PROP. OF SAMRIDDHI CAPITALS (HEREINAFTER REFERRED AS “SAMRIDDHI CAPITALS” OR “THE ENTITY”). BY AGREEING TO THESE TERMS AND CONDITIONS AND USING THE SERVICES IN ANY MANNER, YOU AGREE THAT YOU HAVE READ AND AGREE TO BE BOUND BY AND A PARTY TO THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF THE TERMS OF THIS AGREEMENT ARE CONSIDERED AN OFFER, ACCEPTANCE IS EXPRESSLY LIMITED TO SUCH TERMS. IF YOU DO NOT UNCONDITIONALLY AGREE TO ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU HAVE NO RIGHT TO USE THE WEBSITE OR SERVICES. USE OF COMPANY’S SERVICES IS EXPRESSLY CONDITIONED UPON YOUR ASSENT TO ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT AS WELL AS THOSE IN THE ADVISORY SERVICES AGREEMENT AND PRIVICY POLICY.

Definition:

“Agreement” means this Terms of Service

“Party/party” shall mean and include the Entity, Users and any other person who agrees to be bound by this Agreement;

“Services” means and includes all services listed in our website or any other service, the Entity performs for you

“User/user”, “You/you”, “Your/your” means any natural or legal person who browses, accesses or uses the Website and/or has agreed to avail our Services;

“We”, “Samriddhi Capitals”, “us” and “our” means the entity and its owners

“Website” means domain name “https://www.samriddhicapitals.in/”, owned and operated by Samriddhi Capitals

Terms of Service:

c. Stop Loss Policy: Samriddhi Capitals strictly follow trading discipline and stop loss for each recommended trade under our advisory services. By default, all clients hereby agree to not enter any trade without pre-informed or defined stop loss. If you trade against the stop loss policy, you alone shall be responsible for the same.

d. Payment and Refund Policy: All subscription of or availing services shall be final upon receipt of payment, and there shall be absolutely no refunds. We strongly recommend that before making any payments, all our visitors must read all information about our services, Terms of Service and Privacy Policy. By making payment for advisory fees or subscription fees to Samriddhi Capitals, you acknowledge that you have read and agree to Payment and Refund policy.

e. Mode of Payments: All payments shall be made by account payee crossed cheques / demand draft or by way of direct credit into our bank account through NEFT/ RTGS. You can also pay via app which supports net banking and debit cards. It is clarified that Samriddhi Capitals does not accept cash deposits. All payments should be through legitimate sources and should be in compliance with the policies and guidelines laid down by RBI, NPCI, SEBI, or any other regulatory body. Further, Advisory fees or Subscription fees shall be made through your own Bank account and in case of a joint Bank Account, you shall be one of the holders of such Bank Account.

f. Availability and Eligibility for Services: You understand and accept that not all the services offered on this website are available in all geographic areas and you may not be eligible for all the services offered by Samriddhi Capitals on the website. Samriddhi Capitals reserves the right to determine the availability and eligibility for any service offered.

g. Use of message boards, chat rooms and other communication forums: If this website contains message/bulletin boards, chat rooms or other message or communication facilities (collectively “Forums”), you agree to use the Forums only to send and receive messages and material that are proper and related to the particular Forum. By way of example, and not as a limitation, you agree that when using a Forum, you shall not do any of the following:

• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as right of privacy and publicity) of others.
• Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information.

Further, you shall be solely responsible for any investment decision taken by you on the Services and Samriddhi Capitals shall not be liable for any loss or damage caused to you or other users due to such investment decision, or any kind of reliance upon it.

n. Conflicting Terms: If there is any conflict between this Agreement and other documents, this Agreement shall govern, whether such order or other documents is prior to or subsequent to this Agreement, or is signed or acknowledged by Samriddhi Capitals (including its owner, employees, agents, representative)

o. Change: We have and continue to have the right to modify, change or update this Terms of Service and any other policies as provided on the Website, at any time by reasonably highlighting on the Website about such change. Such changes shall be effective immediately upon posting to the Website. You are advised to keep a regular check and update on the Policy updates on the Website.

p. Compliance with laws: Users shall comply with all the applicable laws as applicable while availing our Services and our Website.

q. Termination: This Agreement and the license rights granted hereunder shall remain in full force and effect unless terminated or cancelled with immediate effect for any of the following reasons: (a) Unauthorized access or use by you (b) If you assign or transfer (or attempt the same) any rights granted to you under this Agreement (c) If you violate any of the other terms and conditions of this Agreement. Termination or cancellation of this Agreement shall not affect any right or relief to which Samriddhi Capitals may be entitled. Upon termination of this Agreement, all rights granted to you will terminate and revert to Samriddhi Capitals. Except as set forth herein, regardless of the reason for cancellation or termination of this Agreement, the fee charged if any for access to Samriddhi Capitals is non-refundable for any reason.

r. Dispute Settlement: All disputes, differences and questions of any nature which at any time arise between the parties to this agreement out of the construction of or concerning anything out of this agreement or as to the rights, duties or liabilities under it or the parties to it shall be referred to the Sole Arbitrator under the Arbitration and Conciliation Act, 1996. The Sole Arbitrator shall be appointed by the owners of Samriddhi Capitals. The Arbitration Proceedings shall be held at Mumbai (Maharashtra) India. The laws prevailing in India shall alone apply to the Arbitration Proceedings between the parties.

s. Jurisdiction: Both the parties agree that all claims, differences and disputes, including any agreements, contracts and transactions made with reference to anything incidental thereto or in pursuance thereof or relating to their validity, construction, interpretation, fulfilment or rights, obligations and liabilities of the parties thereto and including any question of whether such dealings, transactions, or contracts have been entered into or not, shall be subject to the exclusive jurisdiction of the Courts of Mumbai only.

t. Other Terms: Additionally, by usage of our website or services, you are confirming that:

1. You are 18 years of age or older and where you are acting as Guardian on behalf of a minor, you have the necessary authority to register/sign up for the services on behalf of the minor.

2. You have read and understood the Privacy Policy published on the website of Samriddhi Capitals. The information you provide during risk profiling, subscribing for services, KYC and other usage in website is true and correct.

3. Samriddhi Capitals may contact you by phone and/or E-mail and/or SMS or any other form of electronic communication in connection with your registration, advisory and transactions
